39. Jurors shall be summoned to the April and October terms
of said court, and the judges of said court, whenever in their
judgment it may be expedient, may order twenty-five persons
qualified to serve as jurors, to be summoned to attend the said
court as petit jurors at its January and July terms.

40. The judges of said court may pass all such rules as shall
be necessary to facilitate the transaction of business in said court
and such rules shall provide for the transaction of equity business,
for which the court shall be considered as always open.

41. There shall be three county commissioners for Somerset
county, who shall hold their office for two years, and until their
successors shall be elected and qualified.

42. At their first annual meeting they shall appoint a clerk,
who shall receive an annual salary of three hundred dollars, and
who, before entering upon the discharge of his duties, shall take
and subscribe the following oath before one of the said commis-
sioners: "I, A. B., do swear that as clerk of the county commis-
sioners for Somerset county, I will honestly and faithfully, to the
best of my skill and judgment, execute the duties of said office
without favor, affection or prejudice, so help me God."

43. He shall also execute a bond to the State of Maryland, in
the penalty of two thousand dollars, with sureties to be approved
by said commissioners, and conditioned for the true and faithful
performance of his duties; which bond shall be recorded in the
office of the clerk of the circuit court for said county.
