34. It shall be unlawful for any person, at any time, to shoot
or otherwise kill or injure any of the following named birds
within the limits of Somerset county, viz: blue bird, thrush,
martin, swallow, mocking bird, oriole, red bird, sparrow, whip-
poorwill, wren, goldfinch, sapsucker, swamp or branch robin,
hanging bird or woodpecker; but nothing contained in this
section shall be so construed as to prevent the killing or capture
of crows or blackbirds.

35. It shall be unlawful for any person to destroy or disturb
the eggs of any of the birds protected by the provisions of the
preceding section.

36. Any person violating either of the two preceding sections
shall, on conviction thereof, be fined in any sum not less than
two dollars and not more than ten dollars for each offence, to
which shall be added the costs of the prosecution; and all
prosecutions under said sections shall be in the name of the State,
before a justice of the peace of the election district in which said
violation shall occur; and one-half of all such fines shall be paid
to the informer and the other half to .the county commis-
sioners, to be applied by them to the support of the public
schools of said county.

37. The possession by any person within said county, of any
of the birds protected by section 34, shot, killed or otherwise
destroyed, shall be prima facie evidence of a violation of said
section; and it shall be the daty of the constables of said county
to arrest all persons they may detect in or who may be charged
with the violation of any of the provisions of sections 34 and 35,
and to take them before the nearest justice, to be dealt with
according to law.

38. There shall be four terms of the circuit court for Somer-
set county in each year, commencing at Princess Anne on the
second Monday of the months of January, April, July and
October.
