State fishery force, in which case the officer selling shall be paid
such fees as are usual in his general business of collecting execu-
tions, and the balance shall be paid to the county commissioners
for the use of the public schools of Queen Anne's county.

269. Should any person resist any officer in making any arrest
under the provisions of the preceding sections of this sub-title of
this article, said person, upon conviction before any justice of the
peace of Queen Anne's county, shall be fined not less than fifty
or more than five hundred dollars, and stand committed until
said fine has been paid.

270. Any person convicted under any of said provisions of
this sub-title of this article shall have the right of appeal from
the decision of said justice to the circuit court for Queen Anne's
county; provided, the person so appealing shall give bond, with
two sufficient securities, to be approved by the justice trying the
case, in double the amount of the fine imposed, (and also of the
value of the property seized in case he be a non-resident,) with
conditions to prosecute such appeal with effect to the circuit
court at its next session thereafter, and to pay the fine imposed,
and all costs attending such proceedings, in case judgment shall
be affirmed.

271. The waters of Queen Anne's county are hereby so con-
strued that the middle of the channel of Chester river shall be
the dividing line of Queen Anne's and Kent counties, and the
middle of the channel of the Eastern bay, and that portion of
Wye river that divides Queen Anne's from Talbot county, shall
be the dividing line between Queen Anne's and Talbot counties,
so far as they relate to this sub-title of this article.

272. It shall not be lawful for any person, at any time during
the day or at night, by artificial light or otherwise, in or over the
waters of the Chester river and its tributaries, within the Juris-
dictional limits of Queen Anne's county, to shoot at, or to shoot
any water-fowl bedded in flocks upon the feeding or roosting
