144 ANNE ARUNDEL COUNTY. [ART. 2.

orphans' court may sit during the whole term of said circuit
court, if necessary for the despatch of business, and except also
when it shall appear to them to be necessary for the purpose of
examining witnesses or hearing argument in a cause depending
before them.

187. The judges of the orphans' court of Anne Arundel
county shall be exempt from serving as jurors in the circuit
court for said county.

OYSTERS.

1888, ch. 394.

188. It shall be unlawful for any person to use or employ
any boat or canoe licensed to take oysters with rakes and tongs,
in the waters of Talbot, Queen Anne's, Anne Arundel and Dor-
chester counties, in taking or catching oysters with any imple-
ments or device other than ordinary rakes or tongs with wooden
shafts, to be used entirely by hand, and without any ropes or
hoisting gear whatever. Any person violating the provisions of
this section shall be liable to the penalties prescribed in the public
general laws, article 72, title "Oysters, " section 18, for taking
oysters with rakes or tongs without license.

RETAILERS AND TRADERS.

189. The clerk of the circuit court for said county shall in all
cases, before granting a license to any trader or retailer, examine
the person applying for the same, on oath, whether the said
license is intended to be used for the benefit of the person only
in whose name the same is applied for, or for the use or benefit
of any other person.

190. The said clerk shall not grant such license if it shall
appear that the same is not intended for the sole use and benefit
of the person applying for the same, under the penalty of fifty
dollars, to be recovered as small debts are, one-half to the in-
former and the other half to the use of the county.
