1334 HARFORD COUNTY. [ART. 13

boundary between any of said counties, the justices of the peace
of either of said counties bounding on said waters or stream, and
the circuit court for either of said counties, shall have concurrent
jurisdiction; and any person arrested for the violation of any of
the provisions of these sections may be taken to either of said
counties upon whose justices of the peace or circuit court juris-
diction is conferred by this section, for commitment and trial;
and from the judgments of the justices of the peace mentioned in
this section, appeals may be taken on the terms mentioned in the
next preceding section.

126. The possession, between the fifteenth day of October
and the thirty-first day of December of each year, of any net or
trap, used or contrived for the purposes forbidden by section 123,
shall be prima facie evidence against its possessor of its being,
possessed for the purpose of violating that section.

127. Nothing in section 123 shall be construed to prohibit
the use, as now by law allowed, of what are known as hauling;
seines, when laid out from and knded on the shore.

128. It shall not be lawful for any person to fish with seines
in the waters of the Gunpowder river from the twentieth day of
May to the twentieth day of August, and from the first day of
November to the first day of February; and any person so fishing
in said waters shall be guilty of a misdemeanor, and on conviction
of having violated this section shall pay a fine of not less than
twenty dollars nor more than one hundred dollars for each and
every offence.

129. Any sheriff or constable who shall be satisfied, either-
upon his own view or from information received from any other
person on oath, that any person has violated the provisions of the
preceding section, is empowered to arrest the offender.
