1878, ch. 145.

122. Any person violating the provisions of the preceding
section shall forfeit such nets, and the boats and materials used
for fishing the same; and shall also, for each offence, pay a fine

of not less than twenty dollars nor more than fifty dollars.

1888, ch. 390.

123. No person shall, from the fifteenth day of October to
the thirty-first day of December in each year, fish with seine or
net of any kind within the waters of the Chesapeake bay or its
tributaries lying northward by the following line, that is to say:
beginning at the light-house on Turkey Point, in Cecil county,

and running thence westwardly to the most northerly point of
"Spesutia island, in Harford county, and thence west to the main-
land in said last-named county.

124. Any person violating any of the provisions of section
123, upon conviction thereof before any justice of the peace of
the county where such violation took place, or on indictment
before the circuit court for said county, shall pay a fine of not
less than fifty nor more than two hundred dollars, in the discre-
tion of said justice or court; and, in default of payment of such
fine, shall be forthwith committed to the county jail for the period
of sixty days; and from the judgment of said justice there shall
be the right of appeal to the circuit court for the county where
said justice resides; provided, said appeal shall be taken within
ten days from the date of the rendition thereof; but execution
thereon shall not be stayed unless the party appealing shall give
the usual appeal bond to the State of Maryland, in double the
fine imposed and costs, with two sureties, to be approved by said
justice.

125. The justices of the peace of Harford, Cecil and Balti-
more counties, and the circuit courts for each of said counties,
shall have concurrent jurisdiction in all cases that may arise under
the provisions of the two preceding sections, when the violation
of such provisions takes place on the bay aforesaid; and when
such violation takes place on any waters or streams forming the
