1256 GARRETT COUNTY. [ART. 12.

they are elected, any of the commissioners shall die, resign,
remove from the town, or be otherwise disqualified, an election to
fill the vacancy, on ten days' notice thereof being given by the
commissioners, shall be held, at which all persons qualified as
specified in section 113, shall be entitled to vote.

117. They shall have power to appoint a clerk and assign him
his duties, and allow him such compensation for his services as
they may think proper, and all ordinances passed by them shall
be entered by their clerk in a book to be kept by him for that
purpose, which shall be open at all times for the inspection of
any person interested, and copies of all ordinances shall be "put
up in the most public places of the town, that they may be
generally made known.

118. All fines and forfeitures under the ordinances of said
corporation, shall be recoverable as small debts are recovered,
before any justice of the peace, who shall issue his civil writ
against the defendant, and thereafter proceed as in civil cases; or
he shall issue his warrant, as in criminal cases, against the defend-
ant, and shall commit the said defendant, if found guilty, to the
town lock-up, in default of the payment of his fine and costs, until
said fine and costs are paid, not to exceed ten days; but the said
town commissioners may at any time remit the said fine and costs,
if they shall see proper to do so.

119. They shall have full power to make all such by-laws,
regulations and ordinances, not inconsistent with the constitution
and laws of this State, as from time to time they may deem wise,
equitable and expedient for the comfort, health, convenience,
improvement and prosperity of said town and its inhabitants; for
the prevention or removal of nuisances; preservation of health
and suppression' of vice or immorality within the limits of said
town; and shall have power to levy an equal tax on the property
within the said limits, to such an amount as may from time to
time be deemed necessary to accomplish said purposes, which tax
shall be collected and paid to the president and commissioners by
