tificate, shall pay a fee of five dollars, which shall be returned to
the applicant if a certificate be refused; all fees received by the
said board shall be applied to the expenses of carrying out the
provisions of this sub-title of this article, and the excess thereof,
if any, shall be used for the State board of health, an account of
which and how disbursed the said board of health shall report to
the governor.

43. Every person holding a certificate from the State board of
health shall have it recorded in a book to be bept for that pur-
pose in the office of the clerk of the circuit court for the county,
or the clerk of the circuit court of Baltimore city, as the case
may be, in which he or she resides, and the record shall be
endorsed on the certificate; any person removing to another
locality other than that in which his certificate is recorded shall
procure an endorsement to that effect, and shall in like manner
have his or her certificate recorded in the county or city of Balti-
more, as the case may be, to which he or she removes; and the
holder of the certificate shall pay to the clerk of the circuit court
for the county, or clerk of the circuit court of Baltimore city, as
the case may be, the usual fees for making the record.

44. Any person shall be regarded as practising medicine
within the meaning of this sub-title who shall profess publicly
to be a physician and prescribe for the sick, or who shall append
to his name the letters M. D.; but nothing in this sub-title of this
article shall be construed to prohibit students from prescribing
under the supervision of preceptors, or to prohibit gratuitous ser-
vices in cases of emergency; and this sub-title of this article shall
not apply to commissioned surgeons in the United States army,
navy or marine hospital service, nor shall it apply to physicians or
surgeons not resident in this State, who may be called in consul-
tation within this State.

45. The State board of health may refuse certificates to per-
sons presenting diplomas from colleges or schools not in good
standing, or to individuals guilty of unprofessional or dishonor-
able conduct or of criminal practice, and they may revoke
