Tax.

ALLEGANY COUNTY. [ART. 1.

oak, then south twenty-one and a-hajf degrees, west
five thousand two hundred and eighty feet (5,280), to
coruer of bridge pier on Virginia line, opposite lower
end of Hominy Island, then up and with said line to
the beginning; and the property within said limits
shall be subject to such taxes and charges as may be
deemed necessary by the said commissioners, or a ma-
jority of them, to support and maintain the expenses
which may at any time be incurred in the improve-
ment of said town.

Approved and in force April 4, 1870.

BIRDS.

1370, c. 120 adds the following :

1870, c.120, s. 1.
Birds protected

193. It shall not be lawful for any person in Alle-
gany county to shoot, kill or in any way trap or destroy
any blue bird, swallow, martins, robins, cat birds, wood
peckers, sparrows, wrens, whippoorwills, doves, or any
other insectivorous birds, at any season of the year,
under the penalty of two dollars for each bird so killed,
taken or destroyed.

ants and part-
ridges.

194. It shall not be lawful for any person to kill or
destroy any pheasants or partridges between the first
day of January and the first day of September, under
the penalty of five dollars for each and every pheasant
or partridge so killed, taken or destroyed. ,

stroying eggs
or nests.

195. No person shall at any time during the year
wilfully destroy the eggs or nests of any such birds as
are named in this act within this county, under the
penalty of two dollars for each and every offence.

Possession evi-
dence of guilt.

196. The possession by any person within the county
of any of the birds mentioned in this act as shot, killed
or otherwise destroyed, shall be prima facie evidence
to commit under this act.

197. Any person offending against any of the provi-
sions of this act and being convicted thereof before any
justice of the peace in this county, or by the oath or affir-
mation of one or more witnesses, [shall] forfeit the fine or
fines named in this act, one-half to the use of the school
