1864, c. 103 adds the following:

71. Any person or persons, throwing, putting or
placing lime or any other poisonous substances, or
hauling or fishing with seine or net, in any of the
creeks or streams of water, or any of their tribu-
taries, west of Savage Mountain, in Allegany county,
for the purpose of catching, taking, or destroying
fish in any of the said creeks, streams of water, and
their tributaries, in said county, west of Savage
Mountain, shall for every such offence, upon con-
viction thereof before a justice of the peace of said

county, be fined in a sum not less than ten dollars
nor more than twenty dollars, one-half of said fine
to be given to the informer and the other half to
be applied to the primary school fund of Allegany
county. In the event of the failure or refusal of any
person so convicted to pay such fine, the justice of
the peace imposing such fine shall commit him to
the jail of Allegany county for not less than thirty
nor more than sixty days.

FROSTBURG.

Penalty.

1866, c. 47 repeals sections 72, 73, 74, 75, 76, 77, 78, 79, 80, 81, 82, 83, 84 end 87 of this
article and enacts the following in lieu thereof and adds sections:

72. The citizens of Frostburg, Allegany county,
are a body corporate by the style and title of the
mayor and councilmen of the town of Frostburg,
and by that name may sue and be sued, and have
and use a common seal.
