1867, c. 184 repeals this article and the acts of 1864, c. 333 and 1865, c. 181 and enacts

as follows:

Oystermen to
take out
licenses.

SEC. 1. No owner, master, captain, hirer, borrower,
or employee of any owner or other person shall use
or employ any canoe, boat or vessel of any kind or
description whatever in taking or catching oysters
for sale in the waters of this state, or in buying or
selling oysters in the state without having first ob-
tained a license to so use or employ such canoe, boat
or other vessel as hereinafter provided.

2. The comptroller of the treasury shall, upon
the application of any resident of the state of Mary-
land, being the owner of any boat or vessel licensed
or enrolled in any custom house of the United States,
in said state, issue to such resident license to take or
catch oysters with scoop, drag, scrape, dredge or any
other instrument within the waters of the Chesapeake

that said license shall not authorize the taking or
catching of oysters with scoop, scrape, drag or dredge,
between the first day of June and September in each
year, which is hereby expressly forbidden ; and pro-
vided also, that no steamboat or other vessel pro-
pelled by steam machinery shall be used for taking
or catching oysters in any of the waters of this state.
