44 MILITIA. [ART. 63.

him to discharge his duties as commander-in-chief; he shall also
have authority to appoint and commission such assistant adju-
tants general with the rank of major, and not to exceed four in
number, and such other officers and clerks as may be necessary
in his judgment to give efficiency to the organization of said
several departments.

9. The commander-in-chief shall prescribe such rules, orders
and regulations for the distribution of arms, accoutrements,
ammunition and military stores to the militia as he may deem
proper, as also for the safe keeping and return of all such arms
and accoutrements.

10. In case of war, rebellion, insurrection or threatened in-
vasion of this or any neighboring State, the commander-in-chief
is hereby authorized to order out for actual service either for
calling for volunteers, by draft or otherwise, as many of the
militia not exceeding ten thousand men as the exigency may in
his judgment require, and said militia when so ordered to pre-
pare for actual service, shall be organized, officered, armed and
equipped in pursuance of the laws and regulations governing
the United States volunteer forces, and the commander-in-chief
is hereby vested with full power and authority to make all
needful rules and regulations in the premises.

11. The militia accepted by the Governor and all officers
thereof, and staff officers when called into actual service, shall
be entitled to such pay and emoluments as are, or shall be
allowed to the officers, non-commissioned officers and privates
in the United States army from the time of their acceptance as
troops by the State.

12. The salaries of the several department officers shall be as
follows, to wit: the adjutant general shall receive, so long as he
discharges the duties of quartermaster general, inspector gen-
eral and commissary general, as herein before provided, the pay
of two thousand dollars per annum, payable as heretofore; the
aids-de-camp to the Governor shall rank as lieutenant colonel,
but shall not be entitled to any compensation or allowances
