52 CITY OF BALTIMORE.. [ART. 4.

The Act of August 1, 1861, ch. 94, professes to repeal sections 880, 881, and substi-
tutes the following:

57. All taxes now levied, or which hereafter may be levied in
the city of Baltimore, shall be collected within four years from
the levying of the same; and the collection of taxes shall not
be enforced by law after the lapse of said four years, and the
party from whom said taxes may be demanded, may plead this
section in bar of any recovery of the same.

58. Any person enforcing or attempting to enforce the collec-
tion of any tax after the lapse of four years as provided in the
preceding section shall be liable to a penalty of twenty dollars
for each and every offence recoverable before a justice of the
peace in the name of the State; one-half to the informer, the
other half to the city of Baltimore.

The Act of 1862, ch. 148, repeals section 879 and substitutes the following:

59. Nothing herein shall deprive the mayor and city council
of Baltimore of the power to abolish the office of auditor, and in
such event the duties which are confided to the auditor by sec-
tions eight hundred and seventy-four, eight hundred and seven-
ty-five, eight hundred and seventy-six, eight hundred and seven-
ty-seven and eight hundred and seventy-eight of this article,
shall be discharged by the collector, or other officer on whom
they shall or may be conferred by ordinance of the mayor and
city council, and on all arrearages of back taxes collected and
paid over to the treasurer the said auditor or other officer
charged with the collection thereof, shall be allowed a commis-
sion of two and a half per cent, as a compensation for collecting
the same.

TENANTS FOR YEARS OR AT WILL.

The Act of August 7, 1861, ch. 96, repeals section 890 and substitutes the following:

60. One justice of the peace of said city shall have all the
powers conferred upon two justices and a jury by the general
law in relation to landlords and tenants, subject to appeal as in
other cases of judgments by justices of the peace in said city.
