195. If a tie vote shall result in any election the Mayor and Council-
men shall name one of the candidates, who shall be sworn into the office in
which the said tie shall result.*

196. The Mayor shall ex officio have all the powers of a justice of the
peace in cases where the town is a party, and an appeal may be taken
from his judgment to the Circuit Court for Allegany County, in the same
manner as from a judgment of a justice of the peace for said county.

197. The Mayor and Councilmen shall meet at the council chamber
on the first Monday in May next succeeding their election; and the said
councilmen, before they enter upon the duties of their office, shall make
oath before the mayor that they will diligently and faithfully, to the best
of their judgment, perform the duties of said councilmen of said town,
without favor, partiality or prejudice; the mayor shall take the oath pre-
scribed by the constitution before the Clerk of the Circuit Court for Alle-
gany County, or before one of his sworn deputies.

198. They shall meet at the council chambers, or some other convenient
place, every month at a stated time, to be fixed by ordinance, and the
Mayor or any three councilmen shall have power to call special meetings
at any time they may think necessary; and the Mayor shall preside at all
meetings of the council, and have the same power of voting and taking
part in all acts and deliberations of the council as any member thereof;
and in the absence of the Mayor, the council may appoint a president,
who shall have all the powers and privileges of the Mayor except to sign
ordinances; provided that in case of a vacancy in the office of Mayor from
any cause, the council shall select one of their number to act as president
of the council, who shall be Mayor pro tempore, with all the powers and
duties of the Mayor devolving upon him until such vacancy shall be filled
at the general election of officers next ensuing; and all meetings of the
council shall be public.

199. During the month of May, in the year 1897, and every year there-
after, the Mayor and Councilmen shall appoint and qualify a clerk, who
shall keep minutes of their proceedings, which shall be subject to the
inspection of all persons interested therein, and who shall perform all
other duties pertaining to the office; the Mayor and Councilmen shall ap-
point a treasurer, who shall give bond, to be approved by the Mayor and
Councilmen, in such penalty and with such sureties as the Mayor and
