tion of this article, and it shall be the duty of the officer to arrest the person
in command of said boat or vessel, and to seize the said boat or vessel to-
gether with all her equipments and bring the same before a judge or justice
of the peace of the county having jurisdiction, to be dealt with according
to law; provided, that nothing in this article shall be construed to prohibit
vessels from seeking harbor in any waters of this State.

370. The managing owner of such boats shall make oath or affirmation
before the clerk that ho is a bona fide managing owner of such boats de-
scribed in the license; that he has been a resident of said county for the
time before named; that the boat is owned wholly by residents of said
county; that there is no lien, interest or claim on said boats held by non-
residents of Dorchester or Talbot County, respectively, as the case may be,
that the said boat is not held with intention to violate any of the provisions
of the sub-title of these Articles; that said boat has been owned in whole
or in part by residents of such county the six preceding months, if it is six
months old; and the said master of said boat shall also make oath before
said clerk that he has been a resident of said county for twelve months
next preceding the time of taking said oath, and that he will comply with
all laws, general or local, regulating the catching of oysters, and that* the
time of taking such oath he shall exhibit to the clerk the custom house
license if five tons gross or over, and also the certificate of the measurers
of all boats whose gross tonnage, by the rules of custom house measure-
ment, are as shown by said custom house license to be in excess of six tons
gross measurement; and such licensee shall carry such license at all times
when working in his occupation and produce the same when it shall be
demanded by any duly authorized officer.

371. All owners and masters of boats licensed under the two preceding
sections are constituted officers of the county, and clothed with authority to
arrest any and all violators of said sections, and to take such violators be-
fore any judge or justice of the peace, to be dealt with according to law;
and for the purpose of making such arrests, are clothed with the power to
summon a posse comitatus to their aid.

372. Upon information given upon oath to any justice of the peace of
either of said counties, of any violation of section 368, the said justice of
the peace shall issue his warrant for the arrest of the offender, and the
seizure of the boat and furniture on board, which warrant shall be directed
to the sheriff or any constable of the county, or any officer created such by
the preceding section, or to any officer of the State fishery force.
