4624 ARTICLE 21.

and the fifteenth day of March next succeeding; and until such license is
obtained, it shall be unlawful to use or employ any vessel in taking or
catching any oysters, as hereinbefore described; provided, that the waters
of Talbot County, lying between Black Walnut Point and a line drawn
from the southwest corner of Second Kent Point to Wales Point, except
the waters between Poplar Island and the mainland, lying within a
straight line drawn from Pawpaw Point on Tilghman's Island to the
southwesternmost point on Poplar Island and by a straight line drawn
from Lowe's Point on the mainland to Bloody Point Lighthouse (this
line is only to apply to the east or inside of North Point Beach) which are
reserved for the taking or catching of oysters with tongs worked exclu-
sively by hand, shall be open to the citizens of Talbot County licensed
under this section; but it shall be unlawful to take or catch oysters with
scrapes, scoops or dredge in any other waters of Talbot County, provided
further that the said clerks of the said courts, as aforesaid, upon applica-
tion of any owner a resident for one year in either of said counties and
to no other person, of a boat of the size of ten and fifty-two one-hundredths
tons gross or under, which was licensed to take oysters, as aforesaid, with
scoop, scrape or dredge in said waters for the dredging season ending
March the fifteenth, 1916, be and they are hereby authorized and directed
upon a certificate of the admeasurer hereinafter referred to, and provided
for, and upon full compliance with the provisions for the issuing of
license hereinafter referred to, to issue a license for the use of said
boat in taking oysters in the waters aforesaid, in the manner aforesaid;
but no license shall be issued to any boats so licensed for said dredging
season ending on March 15, 1916, the tonnage of which is greater than
ten and fifty-two hundredths gross tons by rules of custom-house measure-
ment, to be ascertained by said admeasurer, and if either of the clerks
authorized by this Act to issue such license shall issue the same without
the said admeasurer's certificate, when such certificate is necessary or
contrary to the provisions of this Act, he shall be deemed guilty of a mis-
demeanor, and upon conviction thereof before a justice of the peace, or
either of said courts having jurisdiction, thereof, shall be fined not less
than one hundred dollars for each and every offense, and stand committed
until such fine and costs are paid.

369. If any boat or vessel shall be seen sailing on any of the waters
which are exempted from scraping by law under this act, in the same man-
ner in which they sail to take or catch oysters with scoop, scrape, drag or
dredge, or similar instrument, the said boat or vessel shall be pursued by
any officer authorized by law to make arrest; and if said boat or vessel
apprehended by said officer shall be found to have on board any wet
oysters, or the dredges or dredge line or deck wet, indicating the taking
of oysters at said time, and properly equipped for taking or catching oysters
with scoop, scrape, drag or dredge or similar instrument, such fact shall
be prima facie evidence that the said boat or vessel has been used in viola-
