4450 ARTICLE 20.

and of the State of Maryland for twelve months, immediately preceding
his application, and is a bona fide owner of the vessel to be used by him,
or upon a certificate of any justice of the peace of said county, certifying
to such application, shall issue to such citizen a license, authorizing him
to catch or take oysters, with scoop, scrape or dredge in any waters of
said county, not parcel of any creek, river, cove or inlet, which license
shall hold good for one oyster season only; and shall only authorize the
catching of oysters as aforesaid between the 1st day of November in any
year, and the 31st day of March next succeeding, on which said last men-
tioned day the said season shall close and end in said county, and said
license shall expire, but no vessel over ten and one-half tons gross meas-
urement, ascertained by proper Custom House measurement, shall be au-
thorized to be used, under any such license, and no vessel over ten and
one-half tons, gross tonnage, shall be used or employed in taking oysters
in any waters of said county; and the said license shall specify the canoe
or vessel to be used by the license, the number and name; and said citizen
shall pay for said license at the rate of two dollars per ton for the vessel
so employed, and the tonnage of vessels and canoes to be licensed shall
be ascertained by Custom House measurements, and no canoe or other
vessel shall be employed in taking oysters with scrapes, scoops, drag or
dredge, or other similar instruments, in the waters of Somerset County,
unless the owner thereof shall first have obtained a license therefor as above
provided; and it shall be unlawful for any person or persons in Somerset
County to take oysters with tongs in any canoe or other sail boat while
said canoe or sail boat is propelled in whole or in part by wind or sail,
which said taking in manner aforesaid shall at all times within said county
be a misdemeanor and punishable as provided for other offences under this
section; and any person having a license aforesaid for any vessel shall
provide a number on canvass, to be prescribed and furnished by the clerk
of the Circuit Court for Somerset County, of the same size as that required
now or hereafter by the State Oyster Law, in red figures, corresponding
with the number of his said license, and shall fix the same securely to
the main sail but on the opposite side thereof from that required by the
State Oyster Law, and shall keep the said number in proper position and
plainly visible at all time while at work, or going to or from work during
the dredging season, and the provisions of this section shall not apply to
Pocomoke Sound, wherein it shall be unlawful at all times to take oysters,
with scoop, scrape, drag or dredge, or any similar instrument; and said
license shall not be transferable; and any person or persons violating any
of the provisions of this section or found guilty of damaging his or their
boat, to escape a just and proper measurement of the same by the Custom
House Officials, shall be found guilty of a misdemeanor, and shall, upon
conviction before any justice of the peace or the Circuit Court for Somer-
set County, be fined in a sum not less than one hundred dollars or more
than three hundred dollars for each offense, or sentenced to the House of
Correction for one year, or both, in the discretion of the Court or justice
of the peace trying the same.
