SOMERSET COUNTY. 4449

Court of Somerset County, the same mileage, in addition to the per diem,
as is now allowed by law and levied for the County Commissioners of
Somerset County.

OUT-PENSIONERS.

243. The trustees of the poor for said county, in their discretion, may
grant an allowance to persons confined to their beds with disease and
unable to be removed to the almshouse, to be continued as long as the
confinement and inability lasts, and no longer; and may grant out-pensions
to others, really necessitous, upon the recommendation of twenty-five of
the taxable inhabitants of the district in which they may reside.

244. It shall not be lawful for any person to take oysters within the-
waters of Somerset county for the purpose of manuring land.

245. It shall not be lawful for any person in said county, or any
person whatsoever, to purchase any oysters for the purpose of manuring
land, from any person whom they know to have caught the same within
the waters of said county.

246. Any person violating the provisions of either of the two preced-
ing sections shall be liable to a penalty of not less than ten nor more than
twenty dollars, to be imposed, upon conviction thereof before a justice of
the peace of the county, one-half to the informer and the other half for
the use of the school fund of the county.

247. It shall be lawful for the citizens of Somerset county to catch
or take oysters with a scoop, drag or dredge, upon obtaining a license
therefor, as hereinafter directed, in any of the waters of said county not
parcel of any creek, cove, river or inlet; and no person shall catch or take
oysters in any of the waters of said county without first having obtained
a license therefor, as hereinafter provided.
