P. L. L., 1888, Art. 20, sec. 173. 1860, Art. 19, sec. 96.

249. The person so applying for a license shall first be required to
make oath that he is a bona fide owner of the vessel to be licensed, that
he has been a bona fide citizen of the State for one year immediately pre-
ceding said application, and six months a resident of the county, and that
the license is intended for his use only.

250. Any person or persons violating any of the provisions of sections
two hundred and forty-seven and two hundred and forty-eight, of this
article, shall be fined for the first offense, not less than fifty nor more
than two hundred dollars, and for second offense, at any time after con-
viction of the first offense, not less than one hundred nor more than five
hundred dollars, and shall stand committed until fine and costs are paid,
and on information, under oath, of any violation of the provisions of said
sections to any justice of the peace of Somerset county, he shall issue his
warrant to the sheriff or constable of said county, requiring either of them
to summon a posse comitatus if necessary, and to proceed at once to arrest
the party or parties alleged to have been engaged in the violation of the
provisions of said sections, and forthwith bring the offender or offenders
before some justice of the peace in and for Somerset county for a hearing,
and the said justice shall either give the case an immediate hearing, or
he shall at the instance of the party or parties charged, appoint some day
within the next seven days thereafter to hear the case, first requiring the
defendant or defendants to give good and sufficient bail for the appear-
ance of the defendant or defendants, and the production of the vessel, if
any shall be taken, at the trial; and if the defendant or defendants shall
be found guilty of violating any of the provisions of this sub-title within
the waters of Somerset county, the said justice shall fine such person or
persons not less than fifty dollars nor more than one hundred dollars if
the said violation of the provisions of this sub-title be the first offense com-
mitted; but for the second offense at any time after a conviction of a
first offense, the said justice shall fine such person or persons not less than
one hundred dollars nor more than five hundred dollars, and such person
or persons so found guilty shall stand committed until the fines and costs
are paid; but in all cases arising under this sub-title, the defendant or
defendants shall have the right of appeal to the circuit court of Somerset
county from the judgment of the justice of the peace; and the canoe, boat
or other vessel so unlawfully used, shall be bound for the fine and costs
in all cases where the master, owner or other person employing the said
vessel in violation of the provisions of this sub-title shall not be arrested,
and shall neglect or wilfully fail or refuse to appear, the justice of the
peace may proceed to hear the said charge so far as it applies to the said
vessel without such appearance, and if the charge appear to be true, the
vessel shall be declared forfeited, but for the first offense shall be released
upon the payment of not less than fifty dollars nor more than one hun-
dred dollars, and for the second offense at any time after conviction of a
