3738 ARTICLE 17.

1916, ch. 426, sec. 4.

91. If any vacancy shall occur by the death, resignation, removal, or
refusal to act of any commissioner of said town, the remaining commis-
sioners shall elect a proper person to fill said vacancy; and all cases of
contested election of said commissioners shall be decided by the judges
of the Circuit Court of Prince George's County; and pending any con-
test, and until the Court shall decide who is legally elected, the commis-
sioners holding the office by virtue of a previous election shall continue
to hold the office until the contested election is decided, and until the suc-
cessors shall be legally elected and qualified.

92. If the citizens of said town at any time neglect to make an election
at the time fixed by this charter, the power of electing commissioners shall
not cease, but shall continue, and the commissioners for the time being
shall continue in office until the election and qualification, of their suc-
cessors.

1916, oh. 426; sec. 6.

93: Every commissioner before entering upon the duties of his office,
shall make oath before some justice of the peace for Prince George's Coun-
ty, that he will diligently and faithfully according to the best of his judg-
ment perform the duties of a commissioner of said town, without favor,
partiality, or prejudice, and a certificate of such qualification shall be
returned by the said justice to the Commissioners to be filed and recorded
among their proceedings.

1916, oh. 426, sec. 7.

94. The Commissioners shall have power to meet and adjourn from
time to time and shall at their first meeting after an election, choose from
their own body a president, who shall preside at all their meetings, vote
on all questions before them, and remain in office until superseded by the
election of a new president after a new election of commissioners.

1926, ch. 426, sec. 8.

95. They may appoint a clerk, prescribe his duties, and allow him
such compensation as they may think proper.

1926, oh. 426, sec. 9.

96. The clerk shall enter all ordinances passed by the commissioners
in a book to be kept by him for that purpose, which shall at all times be
open to the inspection of the public, and copies of all ordinances shall be
put up at the most public places in the village.

97. The commissioners may annually appoint a bailiff, who before
entering upon his duties shall make oath before a justice of the peace of
