may, however, accept from the owner of any land adjoining or abutting
said present road such deed or grant of lands as may be necessary or may
purchase any parcel or strip of land that may be required to accomplish
the widening of the road immediately adjacent, thereto and parallel with
the boundary line of said road where the acquisition of said land will
gracefully conform to the lines of said roadway.

783. The County Commissioners are hereby required to avoid as far
as possible the condemnation of land and premises whereupon buildings
have been located, but the Commissioners shall not be deterred or hindered
in the acquisition by condemnation, purchase or otherwise of any land or
premises either improved or not and such improvement shall be no legal
obstruction in the way of condemnation, but it shall be the duty of said
Commissioners to obtain such land and premises as may be necessary with
the least cost possible under the circumstances. The County Commis-
sioners are authorized and empowered to contract with the Washington
and Rockville Railway Company of Montgomery County or any company
having jurisdiction over said electric railway running along said road for
the purposes herein enumerated and upon such terms and conditions as
may be necessary for the widening and lighting of said highway along
and adjacent to the said line of railway.

784. The County Commissioners are hereby authorized and empow-
ered to contract with the Baltimore & Ohio Railway Company where said
proposed road shall cross over said line of railway in relation to the build-
ing and maintaining a bridge across the tracts to conform to the east line
of the proposed widening of said road.

1922, ch. 391, sec. 5.

785. The State Roads Commission of Maryland are hereby authorized
and empowered to take over said work and condemnation of said land
necessary to widen, locate or re-locate said roadway, construct and main-
tain same in their discretion. That said public improvement may be
made by the use of the county and State funds or by either State or county
funds or Federal aid as may be determined by the County Commissioners
and the State Roads Commission.

1922, ch. 261, sec. 1.

786. The County Commissioners of Montgomery County are hereby
authorized to repair and re-surface any stone road in said county whether
the same was built entirely by county funds, State aid or under the pro-
visions of the Shoemaker Road Law whenever the State Roads Commis-
sion of the State of Maryland shall agree to accept, any such road as part
of the State Highway System and to become a part of same for future
maintenance. That upon the acceptance of any road or roads by the State
