2838 ARTICLE 12.

walk after the failure of the owner, possessor or other person responsible
to do so, shall be a lien upon the said abutting property, in the same man-
ner and to the same extent as taxes are now made a lien by law. And
the Mayor and Town Council shall have the same rights and remedies to
enforce payment of the same, as is now given to them by law to enforce the
payment of taxes, but the Mayor and Town Council shall not be respon-
sible for any damage which may be occasioned by reason of a failure on
the part of lot owners to keep their sidewalks in proper repair.

432. The Town Council shall have power to remove for cause any
officer elected by it; also the power to remove the bailiff for any cause or
neglect of duty and to fill any vacancy in office which it has the power
to fill in the first place, and shall have the power to fill the vacancy of
bailiff if the Mayor fails to fill the place as provided for in the first place.

433. The town clerk, before entering upon his duties, shall take the
oath herein prescribed for members of the Town Council, and shall exe-
cute such bond as may be prescribed by ordinance.

434. The Treasurer shall, before he enters upon his duties, execute a
bond as required by the ordinances of the corporation and shall take the
same oath which is prescribed for members of the Town Council. He
shall have the custody of all corporation funds and shall receive, disburse
and report the same in such manner as may be prescribed by ordinance,
and shall keep a true and accurate account of all financial transactions
of his office. The treasurer shall receive for his services the sum of one
hundred dollars per year.

435. The Tax Collector, before entering upon his duties, shall execute
a bond as required by the ordinance of the town, and shall take the same
oath prescribed for the members of the council. He shall collect all taxes
and other claims which may be due the corporation and shall pay over
and account for the same at such time and in such manner as may be pre-
scribed by law or the ordinances made in pursuance thereof. He shall
assess all the improvements or additions to property in the town which
may be made after a general assessment, and an appeal shall be from his
valuation to the Town Council. He shall receive for his services a com-
mission of five per cent, on all taxes and other claims collected by him.

436. The police magistrate shall be a justice of the peace of the State
of Maryland, in and for Garrett county, residing within the town of Oak-
land. He shall have full authority, power and jurisdiction to hear, deter-
mine and pass sentence in all cases of the violation of the ordinances of
