have the offenders brought before him for trial; he shall have the power
to summon witnesses and to enforce their attendance, both for the corpora-
tion and the accused, by attachment as in like cases before justices of the
peace. But in all cases where a person is convicted of violating any ordi-
nance of said town, and fined in excess of five dollars, he shall have the
right of appeal to the Circuit Court for Frederick County; provided, the
person appealing shall pray the appeal forthwith, and shall give good and
sufficient bond, to be approved by the police justice, Mayor or other per-
son trying the case for the payment of the fine imposed and all costs in-
curred in the prosecution and the appeal, in case the conviction shall be
sustained in the Circuit Court aforesaid. But no appeal shall stay process-
or execution upon the judgment unless a bond be given as above provided.
The person before whom any case for the violation of any ordinance of
said town shall be tried, shall be entitled to receive the same fees as a
justice of the peace would receive for similar services.
If any offender shall be in default for the non-payment of any fine
and costs imposed, he may be proceeded against in a civil action in the
name of the Mayor and Council of Brunswick in the same manner as suits
are brought in this State to recover small debts.
The police justice shall be furnished with copies of the ordinances of
the town, and shall keep a separate docket for corporation cases and
therein shall record and make regular entries of his proceedings in all
such cases, setting forth the fine or imprisonment imposed and the amount
of costs, and he shall submit said docket to the inspection of any person
who may request to see the same; and upon demand of any person inter-
ested he shall deliver a copy of any judgment rendered by him. It shall
be the duty of said justice to make out a summarized report of all cor-
poration cases and all cases for the violation of any ordinances of the
town of Brunswick heard or tried before him during the preceding
month, which said report shall state in each and every case the name of the
defendant, the offense charged, the name of the persons upon whose com-
plaint the warrant was issued, the number of witnesses summoned, the
name and official capacity of the officer serving the warrant, and summons,
the judgment rendered, the amount of fine or penalty imposed, the amount
of costs taxed, which shall include all constable's costs and constable's
fees, where process is served by police officers acting with authority of con-
stables, and the amount of fines and costs collected by him, which said
report shall be submitted monthly to the Mayor and Council. Upon the
request of the Council the said justice shall produce his docket and may
be placed under oath and interrogated as to the entries therein. He shall
pay over to the clerk and treasurer of the Mayor and Council, promptly,
all fines and costs imposed and collected by him, and shall issue written
orders to the clerk and treasurer for the payment of all fees and costs in
all corporation cases tried by him, and said fines shall be a part of the
revenue of the town.
If the police justice neglects to discharge any of the duties imposed
upon him by this Act, or refuses to pay over the fines and costs collected
