2414 ARTICLE 11.

by him, as herein directed, he shall be liable to indictment in the Circuit
Court for Frederick County, and upon conviction he shall be fined the
sum of fifty dollars or imprisoned in the county jail for a term not exceed-
ing three months, or both, in the discretion of the court.

40. The chief bailiff shall be vested and clothed with all the power and
authority of a constable, and any one resisting him or interfering with
him in the discharge of his duties shall be liable, upon conviction in the
Circuit Court for Frederick County, or before the police justice of the
town of Brunswick, in the same manner and to the same extent as if he
had resisted a constable; he shall assist the Mayor in the enforcement of
the ordinances, and to that end it shall be his duty to make complaint to
the police justice against any and every person violating any ordinance of
the town; he shall be executive officer of the Mayor and Council, and
shall serve, deliver or post any order or notice that under any law or
ordinance of the town or under this Charter is to be served, delivered or
posted, and all returns made by the chief bailiff to the Mayor, the Council
or the Mayor and Council shall have, the same force and effect, and be
entitled to and receive the same credence as a return of a sheriff to any
process in the circuit courts of this State; it shall be his duty, as a peace
officer, to maintain and preserve peace, good order and good conduct
within the limits of said town and among all persons found therein; he
shall repress, prevent and put down disorderly conduct and all disturb-
ances of the public peace, breaches of the peace, gambling of all kinds;
the unlawful sale of intoxicating drinks and any and all other unlawful
and criminal acts and conduct whatsoever within the corporate limits oi
said town. Upon the application of the chief bailiff and upon informa-
tion and oath of such officer or upon the information and oath of any
other person, the police justice of said town shall issue a warrant of arrest
directed to said chief bailiff commanding him to make the arrest of the
person or persons named in the information, and said officer shall execute
and return said warrant or writ. If any crime or offense against the
laws shall be committed in the presence of the chief bailiff he shall arrest
the offender without warrant, and if between sunset on one day and sun-
rise on the next day, or at any time on Sunday, the chief bailiff has occa-
sion to arrest any person or persons for any offense committed in said
town, whether the offense was committed in the presence of the officer or
otherwise, and the chief bailiff believes that, under the circumstances, he
ought to make the arrest without delay, said officer may make the arrest
without a warrant and may place the prisoner in the lockup until such
time as the warrant can be obtained. The chief bailiff shall attend the
meetings of the Council. He shall has'e the same fees for making distress
or levying execution for taxes, as are allowed county collectors, and for
making any arrests, or serving process for violations of any ordinance
