CALVERT COUNTY. 1491

Mayor or some justice of the peace of Calvert County, Maryland, to allow
all persons to vote who are qualified to vote under this act, and to allow
none to vote unless so qualified.

1924, ch. 107, sec. 7.

185. The polls shall be kept open from 7 o'clock A. M. until 7 o'clock
P. M. of said election day. The judges shall, after the closing of the
polls, carefully count the ballots cast, and within two days after the said

election make a true and correct return of the same under their hands
to the Council, and shall issue certificates of election to the person appear-
ing from said returns to have received the highest number of votes for
Mayor, and the person receiving the highest number of votes for Treas-
urer, and the six persons receiving the highest number of votes for Coun-
cilmen, and the said certificates shall be recorded among the records of
the proceedings of the Town Council, and the persons who shall respec-
tively receive the highest number of votes shall be Mayor, Treasurer, and
Councilmen for the said town for the ensuing years or until their suc-
cessors are duly elected and qualified.

186. In case; a vote be challenged, the judges of election shall forth-
with hear and pass upon the qualifications of such persons as an elector
under this Act. An appeal may be taken from the decision of the judges
to the Council, which shall, for the purpose of considering such appeals,
be in session on election day from 4 o'clock P. M. until the closing of the
polls.

187. In case of a tie among those receiving the votes of the electors
which shall preclude ai decision that any one has received the highest
number of votes for Mayor or Treasurer, or that any six have received the
highest number of votes for councilmen, in that event the Council shall

designate one of said persons to be Mayor or Treasurer, and Councilman

as the case may be, and shall issue a certificate of election accordingly.

188. If any person elected as Mayor, Treasurer or Councilman shall
refuse to serve as such or his place shall become vacant by death, resigna-
tion, disqualification or otherwise, then the other members of the Council
shall fill the vacancy as early thereafter as possible by appointment from
among the qualified electors of the town; provided, that if such vacancy
occurs by reason of failure to qualify as provided in Section 190, within
two weeks after notice of his election, or otherwise within one month of
the date of election, then and in that case the person receiving the next
highest number of votes for such office ait such election shall be deemed
to have been elected and entitled to qualify.
