614 ARTICLE 99.

Song and Insectivorous Birds.

1927, ch. 568, sec. 23.

23. All species of wild resident or migratory birds not defined as game
birds shall be considered non-game birds, and all wild birds on which
there is an open and closed season shall be considered game birds.

1927, ch. 568, sec. 24.

24. It shall be unlawful for any person or persons within the State to
kill, catch or have in his or their possession, living or dead, any resident or
migratory wild bird other than a game bird, or purchase, offer or expose
for sale, any such wild non-game birds, after it has been killed or caught,
except as permitted by this sub-title.

1927, ch. 568, sec. 25.

25. It shall be unlawful for any person or persons to sell, offer for
sale, barter or exchange the plumage, skin, or body of any bird protected
by this sub-title or have same in possession for sale whether said bird was
captured or killed within the State of Maryland, or within any other State,
territory or Country.

1927, ch. 568, sec. 26.

26. It shall be unlawful for any person within this State to take or
destroy, or attempt to take or destroy the nest or the eggs of any wild bird,
or have such nest or eggs, in his or their possession, except as permitted
by this sub-title.

1927, ch. 568, sec. 27.

27. It shall be unlawful for any person or persons or any corporation
acting as a common carrier, its officers, agents or servants, to ship, carry,
take or transport, either within or beyond the confines of the State, any
resident, or migratory wild non-game bird, except as permitted by this sub-
title.

1927, ch. 568, sec. 28.

28. Sections 24-27 shall not apply to any person holding a certificate
giving the right to take birds, their nest or eggs for strictly scientific pur-
poses, as provided for in Section 29, nor shall it prevent any householder
from keeping any resident or migratory birds in cages as pets, provided
they are not kept for sale, barter or exchange, and that they shall not be
shipped beyond the confines of the 'State.

1927, ch. 568, sec. 29.

29. Certificates may be granted by the Game Warden to any properly
accredited person of the age of twenty-one years or upwards, permitting
the holder thereof to collect birds, their nests or eggs, for strictly scientific
purposes only. In order to obtain such certificate the applicant for the
same must present to the Game Warden written testimonials from two well-
