fines collected under the provisions of this sub-title shall go to the
informer.*

81. From and after April 10, 1918, it shall be unlawful for any
person to dig out or in any manner to take from any den a female fox,
or her young whelps, or kill or in any manner cause the death of such
female fox, or her young whelps, during the period of time in which
she is suckling them. Any person or persons violating the provisions of
this Section shall be guilty of a misdemeanor, and upon conviction
thereof in the Circuit Court of said counties shall be fined not less than
Ten Dollars nor more than Fifty Dollars, or imprisoned for a term not
exceeding ten days, for every female fox or whelp so dug or taken out
of any den, or killed or caused to be killed. One-half of all fines col-
lected under this sub-title shall go to the informer.

82. Nothing in this sub-title shall be so construed as to prevent the
killing of foxes at any time by any person while they are in pursuit, or
in the act of killing or carrying away his, her or their poultry, and pro-
vided further that such persons may be permitted to kill such fox or
foxes within a reasonable time after the pursuit, killing or carrying
away of said poultry.
Destruction of Game Pens, Game Animals, Etc.
1918, ch. 398, sec. 1.
83. It shall be unlawful for any person or persons to wilfully dam-
age or destroy any game pen, fence or other enclosure used for the pur-
pose of raising and propagating of game birds and game animals, con-
structed or maintained upon any land in this State by the owner thereof,
or to wilfully poison, kill, wound, destroy, remove or steal any game
birds or game animals, their young or their eggs, while kept or main-
tained within any such game pen, fence or other enclosure or to enter
into any such game pen, fence or other enclosure, unless by and with
the consent of the owner of the land on which such game pen, fence or
other enclosure is kept or maintained.

84. Whoever shall violate Section 83 shall be liable, upon convic-
tion thereof, to a fine of not less than fifty nor more than one hundred
dollars and imprisonment in the House of Correction for a period of
not more than six months.

85. The Justices of the Peace in the Counties and the Police Jus-
tices in the City of Baltimore shall have jurisdiction to hear and deter-
mine all cases arising under this sub-title, subject to the right of the
accused to pray a jury trial and have his case heard and determined in
the Circuit Courts for the Counties and in the Criminal Court of Bal-
timore City.
*It is far from clear that the act of 1918, ch. 266, was intended to be a general
law, but in view of its title and of the wording of several of its provisions, it is
thought best to codify it.
