road engineer is authorized to go upon any private property
through which said proposed outlet or water course shall pass
and make whatever survey or surveys he may deem necessary
for such purpose; provided, that any such outlet or water
course shall not be opened so as to pass through the buildings,
garden, yards or burial ground or yard of any person without
the consent of the owner or owners in writing.
SEC. 279A. Any person or corporation placing any obstruc-
tion of any kind whatsoever upon the public highways or
bridges, roads, lanes, avenues, streets or alleys of Dorchester
county, or interfering with or obstructing any of the ditches or
drains thereof, or encroaching upon the same with fences or
other obstructions, or any person or corporation, its agents or
employees, exercising the business of a common carrier, per-
mitting his or its vehicle or steam or other engine or cars to
obstruct any crossing for more than five minutes for any one
time, shall be guilty of a misdemeanor, and shall be liable to
prosecution at the instance of the county road engineer of Dor-
chester county or at the instance of any taxpayer of said county,
and upon conviction by any justice of the peace exercising crim-
inal jurisdiction in Dorchester county shall be fined in an
amount not less than five dollars, and not more than fifty dollars
for each offense. Any person arrested under this section shall
have the right of appeal to the Circuit Court for Dorchester
county, and all fines collected under this section shall be paid
to the County Commissioners, and by them applied to the
general road fund of the county.
SEC. 279s. That the County Road Engineer of Dorchester
county shall, on or before the first day of June, 1912, and on
or before the first day of April in each year thereafter, make
up a schedule of the public roads and bridges to be worked,
repaired or rebuilt during that year, and the extent of the
work and repairs to be done thereon, and present the same to
the County Commissioners for their approval or rejection, in
whole or in part, and the said Commissioner's may from time
to time add to said schedule any road, roads and bridges not
included in said engineer's report that are to be worked,
repaired or rebuilt during the year in their respective commis-
sioner districts; the total amount of such schedule not to exceed
seventy-five per cent, of the amount levied for such purposes,
the remainder of twenty-five per cent, of the said road levy
to be kept in reserve for use in making temporary repairs
to any and all other roads and bridges in said county as the
safety and convenience of public travel may squire. And
provided further, that nothing in this act shall be taken or
