ture to the southern boundary line between the States of Mary-
land and West Virginia.

SEC. 9. And be it enacted, That within six months after
the location and survey of said route and the construction of
said line of railway, the president of said company shall file a
plat of the survey of said line and a certificate thereof for
record in the office of the clerk of the Circuit Court for Alle-
gany County.

SEC. 10. And be it enacted, That said company shall con-
struct its railway within the corporate limits of the Town of
Westernport, under the direction and supervision of the munic-
ipal authorities of said town, and said company shall pay annu-
ally to the clerk of said municipality a franchise tax at the
rate of fifty dollars ($50.00) per annum, payable in advance,
the first payment to be made on the first day of January, next
succeeding the date when said road shall be fully constructed
and open for operation and business; and provided further,
that so much of its railway as may be located upon or along
any of the public highways of Allegany county, that said work
of construction shall be done under the supervision of the
Board of Road Directors of said county; and provided further,
that said roadbed and crossings of said railway company when-
ever upon, along or across any of the streets of the Town of
Westernport or the public roads and highways of Allegany
county, shall always be kept in good repair and condition, under
the direction and supervision of the municipal authorities of
said Town of Westernport, and the authorities having charge
and control of the public roads and highways lying contiguous
to said railway in Allegany county, provided, however, that
said corporation before commencing work or construction upon
any portion of any State road or roads included in the State
Roads System, constructed or adopted as a part of the State
Road System, shall apply to the State Roads Commission for a
permit to construct its lines and overhead equipments upon or
over any such road, and all work done under such permit upon
any such road or crossing of said road, shall be done in con-
formity with the rules and regulations of the State Roads Com-
mission, and located and designated by said commission, and in
full compliance with the provisions and terms of any permit,
granted by said State Roads Commission and to the satisfaction
of said commission; and before doing any such work the said
corporation shall file with the said State Roads Commission,
if required, a bond in such amount and penalty as the State
Roads Commission may require for the satisfactory perform-
ance of all the terms and conditions of said permit.
