be divided equally with Epiphany College, one hundred dollars,
as shown by the said last will and testament; recorded in the
office of the Register of Wills for Baltimore City in Liber
(Will) H. W. J. No. 108, folio , etc.

SEC. 2. And also to the following legacies contained in the

last will and testament of Honorah F. Kell, late of Baltimore

City, deceased, which is recorded in the office of the Register

of Wills for said city, in Liber (Wills) N. N. J. No. 112, folio

etc., viz:

1. To James Cardinal Gibbons, Archbishop of Baltimore and
his successors in office according to the organization and govern-
ment of the Roman Catholic Church, a certain picture and
jewelry therein named for the use of St. Gregory's Church.

2. A bequest to Reverend Owen Corrigan of one hundred
dollars for masses to be said for the soul of the testatrix in St.
Gregory's Church.

Approved April 5, 1912.

CHAPTER 420.

AN ACT regulating the construction of fencing along the public
highways of Frederick county, Maryland.

SECTION 1. Be it enacted by the General Assembly of Mary-
land, That it shall be unlawful after the passage of this act.for
anyone owning land along and abutting on the public highways
of Frederick county to build or renew fencing along said public
highways of Frederick county, except it be a barnyard or gar-
den fence, with any other material than wire, excepting the
posts used for the construction of said fencing, which may be
wood, iron or other material.

SEC. 2. And be it further enacted, That all new construc-
tion or renewals of old fencing requiring new material in part
shall be subject to the provisions of this act.

SEC. 3. And be it further enacted, That the Board of
County Commissioners of Frederick County and the Road
Engineer, if there be a Road Engineer in said county, shall
have full control and power to execute the provisions of this
act.

SEC. 4. And be it further enacted. That in any case a
refusal on the part of the landowner (who elects to have a fence
along the public highway) to comply with the provisions of
this act, it shall then be lawful under this act for the said
