voters and taxpayers of Baltimore county, for the position on
said commission so made vacant, one of whom he shall appoint
to the vacancy with the consent of the Senate, if it then be in
session, and if the Senate then be not in session, without the
approval of the Senate. And in the event of the death, resigna-
tion or removal of Asa B. Gardiner, Jr., Republican member
of said commission, or his successor, appointed as herein pro-
vided, the Governor shall request the Eepublican State Cen-
tral Committee of Bajtimore County to designate four persons
who shall be residents, voters and taxpayers of Baltimore
county for the position on said commission so made vacant,
one of whom he shall appoint to such vacancy as aforesaid; pro-
vided, however, that if all of said persons so recommended
by either of said State Central Committees as aforesaid, in
his judgment, shall be unfit or incompetent for said position,-
he shall file a written statement to that effect with the Secre-
tary of State, setting forth euch fact and the grounds there-
for, and thereupon he shall call upon the said committee so
furnishing the original list as aforesaid for another list of four
names of eligible persons for such position, and from said list
and the original list he shall make the appointment in the man-
ner aforesaid.
Chief Engineer of Good Roads Commission.
SEC. 2. And be it further enacted, That, conditional upon
his acceptance of the position, Henry G. Shirley, of Baltimore
county, be and he is hereby constituted and made chief engineer
of the Good Roads Commission of Baltimore County, to hold
office during the life of such commission unless he shall sooner
die, resign or be removed for causes as hereinafter provided.
Said chief engineer shall receive such compensation for his
services as said Good Roads Commission shall determine, in
no event to be less than one thousand dollars per annum so
long as he remains road engineer of Baltimore county, as
well as chief engineer of said Good Roads Commission. He
shall be removable by the Governor for malfeasance in office
after specific charges in writing have been filed and after
giving him a public hearing upon such charges, and not other-
wise. In the event of his refusal to serve, dying, resigning,
or being removed as aforesaid, or in the event of a final
decision by the Courts that he can not hold such position,
which is hereby declared to be one of employment and not
one of public office, or that he is not entitled to receive the
compensation herein provided for, then the Good Roads Com-
mission shall have authority to employ as chief engineer in
his place and stead, to serve for such period as it may employ
