ment and shall upon conviction be fined not less than fifty dol-
lars nor more than one hundred dollars for each offense; one-
half of the fine shall be paid to the informer and the other
half to the mayor and aldermen of Frederick for the use of
public streets. And upon failure or refusal of the party con-
victed thereof to pay such fine cost he shall be committed to the
jail of Frederick County for a period not exceeding ninety
days unless the person convicted shall pay such fine cost before
the day limited in the commitment, in which case he shall be
released.

SEC. 270WWWW. All judges, whether acting as such or
sitting as officers of registration, and clerks of election shall be
allowed and paid three dollars a day; fractions of a day shall
be allowed for at the rate of thirty cents an hour. Each judge
and clerk of election who has performed all the duties and
services required of him by this article shall be allowed pay
for his time, as above provided. When any judge or clerk does
not perform all the services required by this article, then the
city register shall andit his time and allow his compensation
only for the time during which he has actually served.

SEC. 270CCCCC. All cases of contested elections of Mayor
or aldermen shall be decided by the Circuit Court for Fred-
erick County. Said Court may adopt such modes of pro-
ceedings and adjudge costs in such cases as to it shall seem
most satisfactory, but the rules of taking testimony therein
shall be the same as those- which regulate the taking of testi-
mony in other cases cognizable by said Court.

SEC. 225. No ordinance of the corporation which imposes
a penalty by way of fine or imprisonment for a violation thereof
shall be binding on any person who does not reside in the
said city, until the same shall have been published in some
newspaper in said city, except in case of wilful and intentional
violation of such ordinance, after notice thereof; and the said
corporation shall pass no ordinance contrary to law.

SEC. 172. In case of death, refusal to serve, disqualifica-
tion, resignation or removal of the mayor or an alderman, or
aldermen, out of the taxable limits of the city, an election
shall be held by the voters of the said city to fill such vacancy
or vacancies, for the remainder of such unexpired term or
terms, which special election shall be held in the same manner
and under the same restrictions prescribed by this sub-title of
this article for the holding of regular elections of mayor and
aldermen; the board of aldermen shall, within five days after
the date of such death, refusal to serve, disqualification, resig-
