nation, or removal out of the taxable limits of the city, of the
mayor and alderman, or aldermen, fix the time for the holding
of such special election, which time for such special election
shall not .be less than thirty days, nor more than forty days,
after the date of such death, refusal to serve, disqualification,
resignation, or removal out of the taxable limits of the city, the
polling places for such special election shall be fixed in the
same manner and by the same official and the polls shall be
kept open between the same hours, prescribed for the holding
of the regular elections of the Mayor and Aldermen under this
sub-title of this article. There shall be no special registration
of voters for such special election, and only those persons whose
names are on the lists of voters used at the election of the
person or persons, whose place, or places, is, or are, to be filled
shall be entitled to vote at the special election herein provided
for.

SEC. 271. All laws and parts of laws heretofore passed by
the General Assembly of Maryland relative to the corporation
of Frederick and all by-laws, ordinances, resolutions, rules and
regulations, enacted and adopted by the mayor and aldermen
of Frederick, now in force and not in conflict with the pro-
visions of this article, shall remain in force under this act
until the same are altered, amended or repealed. The territor-
ial limit of the city shall remain the same as now provided by
law and all rights and property of every description which were
vested in said city prior to the passage of this act, shall vest in
the same under the organization herein contemplated, and no
right nor liability either in favor or against it now existing and
no suit nor prosecution of any kind shall be effected by the pas-
sage of this act, unless otherwise provided for in this act.

SEC. 272. Candidates to be voted for at all general or
special municipal elections at which, a mayor or alderman are
to be elected under the provisions of this act shall be nominated
by primary election, and no other name shall be placed on the
ballot except those selected in the manner hereinafter pre-
scribed. The primary election for such nomination shall be
held on the second Tuesday preceding the general or special
municipal election. The judges of election appointed for the
general municipal election shall be the judges of the primary
election, and it shall be held at the same place, so far as possi-
ble, and the polls shall be open and closed at the same hour,
with the same clerks as are required for the general municipal
election. Any person desiring to become a candidate for mayor
or alderman shall at least ten days prior to said day of primary
