INTERNAL IMPROVEMENT.— The rail road com-

   

pany discharged conditionally from the

   

obligation to construct and keep up at

   

certain places, a fence of boards,

But must keep up good post and rail

   

fences in such places, and also continue

   

to have notice given of the approach of

   

locomotives in dangerous passes — and

   

shall besides pay all damages that may

   

occur by reason of, &c.

Treasurer required upon requisition

   

of said companies to pay, after six months

   

notice, not exceeding one million to eith-

   

er company in any one year, nor exceed-

   

ing three millions to each altogether,

Which payment shall be from the fund

   

derived from the sale of State stock au-

   

thorised under this act,

No payment to be made to the B. &. O.

   

rail rord company, thereunder, until a

   

majority of the directors appointed there-

   

in by virtue of this act, shall under oath

   

certify to the said Treasurer that they

   

sincerely believe sufficient funds are pro-

   

vided or at the disposition of said compa-

   

ny, including certain subscriptions speci-

   

fied, to complete said road from the Ohio

   

River, by way of, and through Cumber-

   

land, Hagerstown, and Boonsborough, to

   

its present track, near Harper's Ferry,

If they fail to locate said road as speci-

   

fied herein, said company shall forfeit

   

one million of dollars to the State of Ma-

   

ryland, for the use of Washington

   

county,

State entitled to an additional director

   

in said company, for every five thousand

   

shares of stock she shall subscribe there-

   

in over and above what she now has,
