If the Chesapeake and Ohio canal com-

pany and the Baltimore and Ohio Rail
|
|
|
|
Road company, shall accept and in due
|
|
|
|
form certify their acceptance of this act to
|
|
|
|
the Governor, on or before the 1st of Au-
|
|
|
|
gust, the Treasure of the Western Shore
|
|
|
|
shall subscribe for three millions of dol-
|
|
|
|
lars to the capital stock of each of said
|
|
|
|
companies, upon the conditions hereafter
|
|
|
|
prescribed,
|

Upon such subscription the restric-

tions upon taid Rail Road company pre-
|
|
|
|
venting their immediate construction of
|
|
|
|
said road along the Potomac above Har-
|
|
|
|
per's Ferry, rescinded,

Said rail road may be constructed pa-
|
|
|
|
ri passu with the canal, but not preced-
|
|
|
|
ing it,
|

"
|
|
In cases where their juxta position

|
|
|
makes it expedient that the same contrac-
|
|
|
|
tors should construct both works, may do
|
|
|
|
so,
|

If either fails to progress, the other
|
|
|
|
may proceed,
|

Width of the canal to he preserved,

however,

And to be constructed without an in-

creased expense to that company in con-

sequence of this arrangement,

ferences which may arise as to the plan
