ANi act to Incorporate the Cumberland Coal Mining

PasSed MaR. 23,1836

Company.

 

SECTION 1. Se it enacted by the General Assembly of

Incorporated

Maryland, That Walter Smith, Clement Smith, Hen-

 

ry Huntt, Richard S, Coxe, John A. Smith, John

 

Hoye, Samuel P. Smith, Reuben Worthington and

 

Henry naylor, their successors and assigns, shall be

 

and they are hereby made and created a corporation

 

and body politic, by the name and style of the Cumber-

 

land Coal Mining Company, and by that name shall

sue and be sued, implead and be impleaded, answer

 

and be answered, defend and be defended in any and

 

all courts of competent jurisdiction, and as such may

 

have and use a common seal, and change and alter the

 

same at their pleasure, and to have, exercise and en-

 

joy as a corporate body, the powers, rights and privi-

 

leges proper and necessary for the purpose of working

 

coal, iron and other mines in the county of Allegany,

 

and vending the products thereof in their crude and

 

manufactured state, with power for the aforesaid pur-

 

poses, to purchase, hold and use estate, real, personal

 

and mixed; Provided, that the said company shall at

no time hold or possess in this State, for its said

 

mines, and rail road or roads, more than twelve thousand

 

acres of land; And provided also, the lands intended to

be used be located on Dan's mountain, in Allegany

 

county, commencing for a beginning at a point-near

 

Cresap's town, and running with said mountain towards

 

Western Port, parallel with the Potomac; And provi-

ded also, that not more than six hundred thousand dol-

 

lars shall be invested in lands, and that said lands

 

shall be valued by three persons, or a majority of them,

 

appointed by the Governor and Council, in Allegany
