SEC. 20. And be it enacted, That no volunteer divi-

sion which has for two successive years less than two
|

brigades: no volunteer brigade which has for two suc-

cessive years less than two regiments, and no volunteer
|
 
|
regiment, which has for two successive years less than
|
 
|
four such companies as are authorised by the act of
|
 
|
assembly of December session, eighteen hundred and
|
 
|
twenty three, chapter one hundred and eighty-eight, or
|
 
|
by any of the supplements thereto, or by this act shall
|
 
|
continue, and if from the returns or other good autho-
|

rity, the commanding officer of the division shall sus-
|
 
|
pect that the division, or either of the brigades or re-
|
 
|
giments under his command, has not such complement,
|
 
|
he shall cause the same to be investigated, and if it shall
|
 
|
be established to his satisfaction that the said divi-
|
 
|
sion, brigade or regiment has not the said complement,
|
 
|
he shall forthwith report the same to the Governor and
|

Council, who shall thereupon revoke the commissions

of the general and staff officers of said division or bri-

gade, or of the field and staff officers of said regiment.

|
SEC. 21. And be it enacted, That so much of the act

of eighteen hundred and twenty-three, chapter one hun-

dred and eighty-eight, or of any other act as authori-
|
 
|
ses the second regiment of riflemen, the fifty-first re-
|
 
|
giment of infantry, and the twelfth regiment of caval-
|
 
|
ry, be, and the same is hereby repealed.
|
 
|
SEC. 28. And be it enacted. That any clause, matter
|

or thing in the act of December session, eighteen hun-
|
 
|
dred and twenty-three, chapter one hundred and eigh-
|
 
|
ty-eight, or in the supplement thereto, or in the seve-
|
 
|
ral militia raws of this State, which shall be found in-
|
 
|
consistent with, or repugnant to the provisions of this
|
 
|
act, are hereby repealed, so far as relates to the city of
|
 
|
Baltimore; Provided, however, that whenever the mi-
|

litia of the city of Baltimore, or any part thereof shall
|
 
|
be called into actual service, they shall in all respects
|
 
|
be subject to the like regulations and orders, as the
|
 
|
other militia of the State.

SEC. 23 And be if enacted, That nothing in this act
|
Confined to Baltimore
|
shall be construed to extend to any part of the militia
|
 
|
of this State, except within the limits of the city of
|
 
|
Baltimore, nor shall it be construed to impair the pri-
