CHAP. 291

damages, and widening the said lane, or any part of

 

such damages and expenses as they may deem proper,

 

on the persons and property benefited by widening the

said lane, and said assessment when finally made, shall

 

be a lien upon such property, and for collection of the

same; the said persons and property, and extent of da-

 

mages and benefit to be ascertained in such manner as

 

the Mayor und City Council, shall by ordinance di-

 

rect.

Appeals

SEC. 3. And be it enacted, That the said Mayor and

 

City Council shall also provide by ordinance, for

 

granting appeals to Baltimore city court, and securing

 

a Jury trial before said court, to the owner or owners

 

of any property which shall be removed, taken, used,

 

damaged or destroyed By reason of the widening of the

 

said lane, who may deein him or herself aggrieved or

 

injured in the valuation thereof; and also to every

 

other person or corporation, who may deem himself,

 

herself or themselves aggrieved or injured by reason of

 

the assessment on them for the payment of the dam-

 

age consequent upon the widening of the said lane; Pro-

Proviso

vided, that the person or persons, or corporation, who

 

may desire any such appeal, shall within a reasonable

 

time, not less than thirty days, after public notice in

 

all the daily newspapers of said city, of the ascertain-

 

ment and return to the City Register's office of the

 

amount of damage and benefits, apply by petition to the

 

said court for such appeal or jury trial; and the said

 

court shall be, and is hereby empowered to do all such

 

acts in relation to the trial and decision of such appeals

 

as the ordinance of the Mayor and City Council,

 

passed in pursuance of this act, shall direct.

SEC. 4. And be it enacted, That if it becomes ne-

tain cases

cessary in widening the said lane, to destroy or re-

 

move, or take a part of any house or building or lot

 

of ground, and the owner thereof shall claim to be

 

compensated for the whole of such house or building,

 

or lot of ground, the Mayor and City Council afore-

 

said, shall provide for the full valuation thereof, to be

 

ascertained in the same manner as if the whole house

 

or building, or lot of ground, were necessary to he

 

destroyed, removed or taken, with the same right of
