CHAP. 248.

ty, or to the court of Chancery, appear that it will

 

be for the advantage of all concerned in the premises,

 

that such sale or the particular proposed exchange

 

should be made, the children of said Gibson and wife

 

being made parties to .such application; and the court

 

shall decree accordingly: and in case of sale authoris-

 

ed by said court, the same shall be made on such terms

 

as the court shall prescribe, and be subject to all such

 

rules and regulations as are usual in cases of sales in

 

equity: and the court shall direct, and may from time

 

to time change the investment of the proceeds of sale,

 

and pass all such orders in relation thereto, as the in-

 

terests of the parties may appear to require; and in

 

case of any exchange, equality of estate shall not be

 

required, but the benefits and advantages for the par-

 

ties concerned in the said trusts shall alone be regard-

 

ed.

 

CHAPTER 248.

A supplement to the act, entitled, an act for the promo-

 

tion of Internal Improvement.

Commissioners

Be it enacted by the General Assembly of Maryland,

 

That Samuel Jones, Jun., William Krebs, and James

 

W, McCulloh shall he, and they hereby are appoint-

 

ed commissioners, who shall have, use, and exercise

 

and perform whatever power, function, or duty was by

the act, entitled, an act for the promotion of Internal

 

Improvement, passed at December session, eighteen

 

hundred and twenty-five, conferred or imposed upon

 

the hoard of public works, in relation to the Maryland

 

Canal Company, and the estimate and plan of the Ca-

 

nal thereby authorised to be constructed, and shall al-

 

so be, and they hereby are substituted for, and shall

 

perform the duties of the commissioners by the said

 

act directed to be appointed, and may proceed to per-

 

form those last mentioned duties so soon as they shall

 

be satisfied of the practicability of excavating the said
