CHAPTER 228.

CHAP. 228.

 

Passed Mar. 25,1836

An act for the relief of James Dirickson and William

 

Holland, and the Trustees of the Berlin Academy,

 

in Worcester county.

Preamble

WHEREAS, it is represented to this General Assem-

 

bly, that John Postly, late of Worcester county, did

 

by his last will and testament devise and bequeath a

 

certain portion of his estate, to be applied for the

 

benefit and education of poor and necessitous young

 

people in the hundreds of Buckingham, and Worcester

 

hundreds, in Worcester county, and appointing cer-

 

tain persons and their successors, trustees for the

 

management of the said fund, And whereas, it is further

 

represented to this General Assembly, by the petition

 

of James Dirickson and William Holland, the succes-

 

sors of said trustees, appointed under said will, that

 

the objects and purposes of the said testator, John

 

Postley, could be more effectually carried out by trans-

 

ferring and vesting the said trust and fund in the

 

Trustees of Berlin Academy, in Worcester county, —

 

Therefore:

Payment over di-rected

SECTION 1. Be it enacted by the General Assembly of

 

Maryland, That said James Dirickson and William

 

Holland, be, and they are hereby authorised, empow-

 

ered and required to pay over and transfer to John R.

 

Ritts, Isaac Covington, John S. Purnell and Henry

 

Franklin, Jr. Trustees of Berlin Academy in Wor-

 

cester county, all such sums of money, bonds, mort-

 

gages or evidences of debt as now are or may hereaf-

 

ter come into their hands, under and by virtue of the

 

trust in the will of John Postly, late of Worcester

 

county, deceased, to be by them and their successors

 

applied at their discretion towards carrying out the

 

objects, and design, mentioned in said last will and

 

testament of John Postley, and to and for no other use,

 

intent or purpose whatsoever; Provided nevertheless,

 

that this law shall not be construed to affect the rights

 

and interests of any one or more of the legal represen-

 

tatives and heirs at law of the said John Postley.
