CHAP. 223.

An act to authorise the laying out and opening a Road,

Passed Mar.25,1836

in Cecil county, therein mentioned.

 

WHEREAS, it is represented to this General Assem-

bly, by the petition of sundry inhabitants of Cecil

 

county, that they labour under great inconvenience

 

for want of a road commencing at Octoraro Bridge

 

near Rowlandville, by the way of Kirks Factory, to

 

intersect the road leading from Port Deposit, to Fry's

 

Forge, at or near Liberty Grove school house: — There-

 

fore,

 

SECTION 1. Be it enacted by the General Assembly of

Commissioners to

Maryland, That Samuel Rowland, Joseph Moore and

lay out and open

James Broughton, be, and they are hereby appointed

 

commissioners for the purpose of ascertaining the pro-

 

bable cost and expence of laying out, opening, and

 

clearing the road aforesaid, and report the same to the

 

commissioners of said county at their next meeting

 

thereafter.

 

SEC. 2. And be it enacted, That when the commis-

probable cost and expence of laying out, opening and

 

clearing the said road, and reported the same to the

 

county commissioners aforesaid, who may if they deem.

 

it expedient and advisable to open said road as afore-

missioners or a majority of them, to contract and

 

agree with any person or persons, upon the best and

 

cheapest terms they can, to lay out, open and clear

 

said road, and shall take the contractor or contractors

bond or bonds with good and sufficient security or se-

 

curities, under such penalty or penalties, as the said

 

commissioners or a majority of them, may think right

 

and proper, for the faithful performance thereof; Pro-

 

vided, that the said road shall not go through the gar-

 

den, yard or meadow of any person or persons, with-

 

out his, her or their consent.

 

SEC. 3. And be it enacted, That the said road when
