through the buildings, orchard, garden or yard of any

person or persons, without his, her or their consent.

SEC. 3. And be it enacted, That the aforesaid com-
|

missioners, or a majority of them, shall ascertain the

amount of damages which any person or persons may
|
 
|
sustain by the laying out and marking said lot of ground,
|
 
|
which amount they shall return to the levy court of
|
 
|
Worcester county, who are hereby authorised and di-
|
 
|
rected to levy on the assessable property, of said coun-
|
 
|
ty, a sufficient sum to cover all such damages, and pay
|
 
|
the same to the person or persons entitled thereto.
|
 
|
SEC. 4. And be if enacted, That it shall be the duty
|

of the aforesaid commissioners, after having as above

prescribed laid out and marked said lot of ground, to
|
 
|
offer the contract for building said wharf by advertise-
|
 
|
ment, placed in at least five of the most conspicuous
|
 
|
places in the neighbourhood, to the lowest and best
|
 
|
bidder, who shall give bond in a penalty double the
|
 
|
amount of the contract, with security, to be approved
|
 
|
by the commissioners for the construction and comple-
|
 
|
tion of the said wharf in a durable and workmanlike
|
 
|
manner.
|
 
|
SEC. 5. And be it enacted, That the aforesaid com-

missioners, or a majority of them, after contracting for

|
the building and completion of said wharf, shall report
|
 
|
the amount and terms of contract to the levy court of
|
 
|
Worcester county, who are hereby authorised and re-
|
 
|
quired to levy the same upon the assessable property of
|
 
|
said county, to be paid by the collector to the builder
|
 
|
or builders of said wharf, or his or their order.
|
 
|
SEC. 6. And be it enacted, That the justices of the
|

peace of the levy court for Worcester county may, in
|
 
|
their discretion, allow to each of the aforesaid commis-
|
 
|
sioners two dollars per day, and no more, for each day
|
 
|
they may be necessarily employed in executing the
|
 
|
duties imposed by this act.
