1835.

an act for the establishment and regulation of the Levy

CHAP. 148.

Courts of the several counties in this state; And

 

whereas, also, the said Abel S. Greenwell has from the

 

time of passing said bond, been performing the duties

 

of constable, and it is apprehended that his acts as

 

such may be invalid: — Therefore.

 

Be it enacted by the General Assembly of Maryland,

An confirmed

That all acts heretofore performed by the said Abel S.

 

Greenwell, as are not inconsistent with the duties of

 

constable, be and the same are hereby confirmed and

 

made valid, precisely as if the securities on said bond,

 

had been approved by the said clerk, and his approval

 

thereof been endorsed on said bond, agreeably to the

 

act of Assembly aforesaid.

 

CHAPTER 148.

 

An act for the relief of John Guyton, of Harford county.

Passed Mar.19,1836

WHEREAS, it appears to this General Assembly, by

Preamble

the petition of John Guyton, of Harford county, that

 

the commissioners of said county appointed road com-

 

missioners to alter and amend a certain road in said

 

county, and said road commissioners in their estimate

 

of damages included the timber on the bed of said road

 

as a part of the soil, and by the direction of the county

 

commissioners, said Guyton was appointed supervisor

 

of the road then to be opened, and by said road com-

 

missioners was authorised to take the timber growing

 

on the bed of said road, as a portion of the soil, and

 

thereby subjecting the said Guyton to an action of

 

trespass, which action having been successfully prose-

 

cuted against him by the owner of the land, although it

 

appears that the full value of the timber was included

 

in the levy paid to the owner, and although nominal

 

damages were obtained against said Guyton, yet he has

 

incurred heavy damages and costs: — Therefore,

 

SECTION 1 Be it enacted by the General Assembly of

Levy and payment

directed

Maryland, That the commissioners of Harford county,

 

he and they are hereby authorised and directed to levy

 

on the assessable property of said county, and cause to
