LAWS OF MARYLAND.

CHAP. 122.

public road, by the Baptist meeting house, to Cedar

 

Hall, or to make such alterations in said road as they

may deem necessary; provided, that nothing in this act

 

shall be construed to prevent the owner or owners,

 

through whose lands said road may pass, from having

 

the privilege of keeping a free gate on said road.

Plat— record

SEC. 3. And be it enacted, That the said commis-

 

sioners, or a majority of them, are hereby directed to

 

return a plat of the said wharf and road, when survey-

 

ed, marked and laid out, and made public as aforesaid,

 

to the clerk of the county court, to be by him recorded;

 

which wharf and road shall forever thereafter, be

deemed and taken as a public wharf and road, and

 

shall be kept up and repaired as other public wharves

Restrictions

and roads in said county are; provided, that nothing

 

herein contained shall in any manner authorise the

 

said commissioners to lay out the said wharf and road

 

through the buildings, orchard, garden or yard of any

 

person or persons, without his, her or their consent.

Damages

SEC. 4. And be it enacted, That the aforesaid com-

 

missioners, or a majority of them, shall ascertain the

 

amount of damages which any person or persons may

 

sustain,by the laying out and marking said lot of ground

 

and road, which amount they shall return to the leyy

 

court of Worcester county, who are hereby authorised

 

and directed to levy on the assessable property of said

 

county, a sufficient sum to cover all such damages, and

 

pay the same to the person or persons entitled thereto.

Construction of wharf

SEC. 5. And be it enacted, That it shall be the duty

 

of the aforesaid commissioners, after having as above

 

prescribed, laid out and marked said lot of ground for

 

a wharf, to offer the contract for building said wharf,

 

by advertisement, placed in at least five of the most

 

conspicuous places in the neighbourhood, to the lowest

 

and best bidder, who shall give bond in a penalty

 

double the amount of the contract, with security to be

 

approved by the commissioners, for the construction

 

and completion of the said wharf in a durable and

 

workmanlike manner.

Payment therefor

SEC. 6. And be it enacted, That the aforesaid com-

 

missioners, or a majority of them, after contracting

 

for the building and completion of said wharf, shall
