LAWS OF MARYLAND.

lay out and open a road not exceeding thirty feet in

bess' mill, near the old liberty road, in Frederick

 

county, and running by the nearest and most practi-

 

cable rout to the end of the road recently laid out from

 

Lisbon, in Anne Arundel county, past Reubin War-

 

field's store, on the Baltimore and Ohio Rail Road, to

the Piney Old Field in Baltimore county, and the

 

said commissioners or a majority of them shall make

out a plat of that part of the road through Fred-

 

erick county, and return the same to the clerk of

 

the conrt of Frederick county, to be recorded among

 

the records of said county; they shall also in like

 

manner make out a plat of that part of the road

 

through Baltimore county, and return the same to the

Record

clerk of said county court to be recorded among the

 

records of Baltimore county court, and the said road

 

when so opened, shall be thereafter deemed a public

road forever, and shall he kept in repair in the manner

 

as other public roads are dire'cted to be kept in said

 

counties.

Payment of expen-

SEC. 2. And be it enacted, That the expenses of sur-

veying and opening that part of the road in Frederick

 

county, shall be paid by Frederick county, the expen-

ses of surveying and opening that part of the road in

 

Baltimore county, by Baltimore county, and the Levy

 

courts or commissioners of said counties as, the case

 

may he, are hereby authorised and required on re-

 

ceiving from the commissioners appointed or a major-

 

ity of them, an account on oath or affirmation of the

 

said expenses, including an allowance of two dollars

 

per day to the commissioners for every day they may be employed in the survey, location, and construction

of said road, to levy the same on the assessable pro-

 

perty of said counties respectively, to be collected as

 

other county charges are now collected.

Damages

SEC. 3. And be it enacted, That the said commission-

 

ers or a majority of them shall value and ascertain the
