SEC. 4. And be it enacted, That so much of the act

Repealing clause

to which, this is a supplement, as may be inconsistent with, or contrary to the provisions of this act, be and

 

the same is hereby repealed.

 

CHAPTER 109.

Passed Feb. 18, 1836

An act to locate a public Landing, at or near the head of

 

the tide waters of the Great Falls of Gunpowder, in

 

Baltimore county.

Preamble

WHEREAS, it is represented to this General Assem-

 

bly, by the petition of sundry taxable inhabitants of

 

Baltimore county, that a public landing, at or near the

 

head of the tide waters of the Great Falls of Gunpow-

 

der, in Baltimore county, would be of great convenience

 

to the people of the vicinity, — Therefore:

Commissioners to

SECTION 1. Be it enacted by the General Assembly of

locate, &c

Maryland, That the Commissioners of Baltimore coun-

 

ty, be and they are hereby authorised to appoint three

 

persons as commissioners, whose duty it shall be to

 

locate a public landing, at or near the head of the tide

 

waters of the Great Falls of Gunpowder, in Baltimore

 

county, as in their judgment will be most eligible for

 

the purposes of said landing.

Purchase lot

SEC. 2. And be it enacted, That the said commis-

 

sioners appointed by the Commissioners of Baltimore

 

county, be authorised to purchase any lot of ground

Public landing

which they may select for said public landing, and up-

 

on such purchase the said lot of ground shall be forever

Limitation

considered and used as a public landing; Provided said

 

lot of ground does not exceed one acre, or does not a-

 

mount to a sum pf money over one hundred dollars.

Appraisement and condemnation

SEC. 3. And be it enacted, That if said commission-

 

ers cannot purchase said lot of ground at or under the

 

above price of one hundred dollars, then, that the

 

Sheriff of Baltimore county shall summon a jury to

 

value said lot of ground, which valuation shall be re-

 

turned to the Commisoioners of Baltimore cdunty, and

 

if approved by them, and uppn payment of said valu-

 

atiqn to the owner or owners of said lot of ground, then
