CHAP. 266.

nance which the mayor and city council shall pass by vir-

 

tue and in pursuance of this act, provision shall be made for

 

a trial by jury in any case of such appeal, at the instance of

 

the appellant or appellants in the particular case of appeal.

 

CHAPTER 266.

A further supplement to the act, entitled, An act to authorise

 

the laying out and opening a road through Frederick,

 

Anne Arundel, and Montgomery counties.

Preamble.

WHEREAS, by virtue of an act of this general assembly,

 

passed December session, eighteen hundred and twenty-

 

eight; a public road was laid out and opened through a part

 

of Frederick county, to wit: from the old Liberty road,

 

near Alexander Warfield's mill, to New Windsor, and

 

thence to Union town; but a part of said road unfortunately

 

passing over very boggy ground in consequence of which

 

that part of the said road is generally impassable, for reme-

 

dy whereof,
