is a supplement, and in valuing and condemning land for said

road, and returning the costs and expenses of the same,

they shall take the oath or affirmation as provided by the

act to which this is a supplement; Provided nevertheless, that

nothing in this act shall be construed to authorise the shut-

ting up of any part of the now public road leading from
|
 
|
New Windsor, to Union town, unless the consent of the le-
|
 
|
vy court of Frederick county be first had and obtained; and
|
 
|
the said levy court is hereby authorised and empowered to
|
 
|
shut up any part thereof, and restore the lands thereof to the
|
 
|
late owners on such terms and conditions as to the said levy
|
 
|
court may seem just and proper.

CHAPTER 267.

An act authorising the Commissioners of Allegany County,

Section 1. Be it enacted by the General Assembly of Ma-
|

at their next meeting after the passage of this act, appoint

three discreet individuals, residents of the county, whose
|
 
|
duty it shall be to examine and change the location of the
|

road from Old Town, to Cumberland, in said county, at

such places only, as in their judgment and discretion they
|
 
|
may deem expedient and proper, wherever it may lessen
|
 
|
distance and improve the road between the two extreme
|
 
|
points, and the persons so appointed shall make report of
|

probable costs of effecting and completing such alterations

and improvements as they may recommend, and where it is
|
 
|
most susceptible of improvement and advantageous to pub-

lic interest.

Sec. 2. And be it enacted, That provided the said esti-
