government of the said school or schools agreeably to the
fourth section of this act, and the said trustees may proceed
to build a house or houses for the purposes aforesaid, and
when built and prepared for the reception of a school or
schools, they shall certify the same to the judges of the or-
phans' court aforesaid, who shall and may pay over to the
said trustees or their order, their distributive portion of the
fund appropriated to the said district in which said hou«e
or houses shall be built, agreeably to the number of schools
which shall have been returned as established by the said
commissioners, which said trustees may apply the first
years apportionment to assist in the building said school house
or houses, as the case may be.

Sec. 6. And be it enacted. That when the said schools
shall have been organized as aforesaid, and having procur-
ed a teacher or teachers approved of by the trustees there-
of, and have made up the number of at least fifteen regular-
ly subscribed scholars for the year, residents of said county,
and continued therein for the term of one year, the same
having been certified to the said orphans' court, by the re-
spective trustees in the several schools in the several dis-
tricts, shall be entitled to draw from the said orphans' court,
their distributive portion of the donation to the said district
respectively, for the payment of their teacher or teachers,
which they may have had employed for and during the
term aforesaid, which payment shall be made by the said
court in the month of December annually.

Sec. 7. And be it enacted, That if any of the commission-
ers appointed for the different districts of said county, by
virtue of this act, should refuse or neglect, or in any wise
become incapable to act, that the other commissioners are
hereby authorised to fill such vacancy or vacancies, as the
case may be, for the purpose of carrying into effect the pro-
visions of this act.

Sec. 8. And whereas, it appears that there is an ambigui-
ty in the law, making a distribution of the donation to the
Hillsborough school and Denton academy, which passed the
legislature of Maryland, at December session, eighteen
hundred and thirty, chapter one hundred and seventy; in
consequence of which the orphans' court have declined to
draw the sum of five hundred dollars, which is due the said

county; Therefore be it enacted, That the said orphans'
court shall postpone the drawing of the said fund, until the
first Monday of October next, and then they shall proceed
to draw from the treasurer of the western shore, the said
sum of five hundred dollars, and when so drawn, shall, and
