number of votes in the separate districts in which he or
they shall reside as aforesaid, are duly elected commission-
ers for Cecil county, to serve for the period of two years
from the date of their said elt'ction,and that the persons elected

as commissioners aforesaid, shall out of their own body elect
their president; and if any commissioner or commissioners

so elected, shall die, resign, refuse or neglect for twenty
days to qualify as commissioner under this act, or shall re-
move from the said county at any time within the peiiod
for which he shall have been elected, the governor and
council shall appoint a person qualified as is hereinbefore
provided, in case of an original election, to fill his place,
until the next annual election for delegates to the General
Assembly, when a person shall be elected in the manner
provided for in the preceding part of this section, out of
the district where such commissioner or commissioners so
dying, resigning, relusing, neglecting to qualify, or remov-
ing from the county as aforesaid, was elected.

Case of vacancy.

Sec. 2. And be it enacted, That every commissioner elec-
ted or appointed as aforesaid, shall, before he enters on the
duties of his office, take and subscribe before sorre judge or
justice of the peace, an oath or affirmation, that he will
faithfully, diligently and impartially exercise the powers
and perform the duties of commissioner for Cecil county,
as authorised and enjoined by law, according to the best of
his skill and judgment, without being influenced by favour,
affection, hatred, malice, or ill will; and that he will, in ma-
king all appointments to office, vote for such person among
those willing to accept, as in his judgment and belief shall
be most capable and best qualified to perform the duties of
such office; which oath shall be recorded in a book to be
kept among the records of Cecil county court.

Oath prescribed.

Sec. 3. And be it enacted, That the commissioners elected
or appointed as aforesaid, and their successors, shall be, and
they are hereby constituted a body politic and corporate,
by the name, style and title of the commissioners of Cecil
county, and by that name shall have continued and perpetu-
al succession, and be capable in law of sueing and being
sued, of making and using a corporate seal, and of altering
the same; of taking, holding, selling and conveying all kinds
of estates, properly and effects, and of doing all such acts as
shall be necessary to the exercise of all powers which are
or shall be vested in them by this act, or any other act of
assembly, as fully and effectually as corporate bodies may
or can lawfully and rightfully do.

commissioners to be elected or appointed as aforesaid, shall
have taken and subscribed the oath or affirmation hereinbe-
